High Court ruling against unfair clauses on mortgages

The High Court has ruled and ordered the cancellation of certain clauses contained in contracts for credit cards, loans and mortgages subscribed through Banco Santander, BBVA, Caja Madrid and Bankinter, which it considered unfair, disproportionate and confusing, thanks to the appeal lodged by the Consumers’ and Users’ Organization (OCU).

With regards to mortgages, the clause that prohibits the lease of mortgaged properties is declared unfair, although the High Court recognized that such actions may diminish the value of the property. However, this inconvenience is remedied by amending the clause that specifies the income required by the owner to rectify “the decline in value” that the lease may cause the bank in case of loan default and the need to execute the property.
